A power of attorney has to be translated when the document will be used in another country, at a foreign authority, an embassy, a notary, a court, a bank, the Public Registry, a company or another official organisation. If the power of attorney is drawn up in Georgian and has to be submitted abroad, in most cases it has to be translated into the relevant language. If the power of attorney is in a foreign language and has to be used in Georgia, it has to be translated into Georgian.

Powers of attorney are used for a wide range of purposes. They may concern property rights, bank accounts, a car, a child's documents, court proceedings, company representation, inheritance, a visa application or another administrative matter. That is why the translation must not be a general one, but an exact reflection of the legal content of the document.

What types of powers of attorney do we translate?

A power of attorney may be general or grant a specific authority. Sometimes the document is very short and covers only one action, for example collecting a document or filing a specific application. In other cases the power of attorney may be long and cover several powers, property matters, banking transactions, representation in court or acting on behalf of a company.

When translating, it is important to understand the content of the document correctly. For example, if the power of attorney concerns the sale of real estate, the description of the property, the address, the owner's details and the scope of authority must be translated exactly. General power of attorney vs. special power of attorney

A general power of attorney gives the representative broad rights in several areas at once: managing property, banking transactions, representation before state authorities, concluding contracts. A special power of attorney is issued for one specific action or matter, for example the sale of one apartment, the re-registration of one car or one court case. In foreign documents you will see them as General Power of Attorney and Special or Limited Power of Attorney.

The title does not define the representative's rights. Even a "general" power of attorney covers only the actions listed in the text. That is why in the translation we render each power separately, in the same order and to the same extent as in the original: we neither broaden nor narrow it. Under Article 109 of the Civil Code of Georgia, a power of attorney terminates on expiry of its term, on revocation, on the death of the principal or on completion of the assignment, so the term and revocation conditions are also translated exactly.

One word can stop a transaction. "Management" (მართვა) and "disposal" (განკარგვა) are different rights in Georgian: the first does not include the right to sell the property, the second does. If "disposal" was translated as manage, or the other way round, dispose of was rendered as "management", the Public Registry or a foreign notary will not register the sale, because according to the text the representative does not have that right. Signing the contract, setting the price, receiving the money and delegating the authority to someone else are also separate rights.

Does a power of attorney need notarization?

A power of attorney is often a notarial document itself, but when it is translated, the receiving party may require a notarized translation. This is especially common when the document is used abroad, in court, at a bank, at the Public Registry, at an embassy or at another official authority.

A notarized translation gives the document an official form and is often needed for an administrative or legal body to accept the translation. If you have to submit the power of attorney to a specific authority, it is advisable to check in advance whether they require notarization.

Does a power of attorney need an apostille?

Whether an apostille is needed depends on the country and the authority where you have to submit the power of attorney. If the document is to be used abroad, in some cases the original power of attorney has to be certified with an apostille, sometimes a notarized translation is required, and sometimes both procedures together.

Checking the requirements is especially important when the power of attorney concerns real estate, taking a child abroad, representation in court, inheritance or a banking transaction. Such documents are often checked strictly, so preparing the wrong format can hold up the process.

Translation of statements, affidavits and notarial deeds

• Statement renouncing an inheritance - under Article 1434 of the Civil Code, renunciation of an inheritance is made before a notary, and the deadline is 3 months from the day the heir learned or should have learned that they were called to the inheritance. Under Article 1435, renunciation cannot be partial or conditional, so not a single word in the translation may read as a condition or restriction;
• Affidavit - a written statement made under oath or solemn affirmation, which mainly comes from the USA, the United Kingdom, Canada and Australia. In the Georgian translation, the certification clause of the notary or the person administering the oath (jurat) is translated separately;
• Consent for a child to travel abroad - details: parental consent translation;
• Other statements executed with signature certification - for a bank, an embassy, a university or a company.

Power of attorney translation for real estate

A power of attorney related to real estate is often used for a sale, a purchase, registration, representation at the Public Registry or another property procedure. Such a document may state the details of an apartment, a land plot, a commercial space or other property, the address, cadastral information, the scope of authority and the period of validity.

Every term in a property power of attorney matters. The translation must render exactly which right the representative has: to sell, to sign, to receive money, to register, to submit documents or another action. That is why we approach such documents with particular care.

Power of attorney translation for taking a child abroad

A power of attorney or consent related to taking a child abroad is one of the most sensitive documents. It must correctly state the details of the parent or legal representative, the child's details, the country, the purpose of the trip, the period and the person the child is travelling with.
